You represent and warrant that you have reviewed the safety materials provided in the App and on the Move website. You are familiar with the operation of the E-scooter or E-bike, and you are reasonably competent and fit to ride the E-scooter or E-bike. You further agree that you are solely responsible and bear the risk for any injuries, medical conditions and/or medical complications.

Permitting another person to use an E-scooter or E-bike activated by you constitutes a material breach of this Agreement.

You will cease operation of the E-scooter or E-bike if you are concerned about the operation of or a malfunction or damage to the E-scooter or E-bike. You must contact Move immediately if you have difficulties operating the E-scooter or E-bike. Said difficulties include but are not limited to the following:

If you lack experience or skill in driving E-scooters or E-bikes, you must take the training we provide online or in person before your first ride. You will be solely and fully responsible for any losses or damages due to a lack of training. Move is not responsible for ensuring that you are trained to drive an E-scooter or E-bike.

You must report to Move immediately when any of the following occurs: accident, damage to E- scooter, malfunction of E-scooter or E-bike, personal injury, traffic violation, lost E-scooter or E-bike, technical difficulty of Move App that affects the use of E-scooter or E-bike, or any other situation that a reasonable user would consider as advisable or necessary.

PART II: OTHER SAFETY REQUIREMENTS

You must wear a correct, proper and well-fitted helmet meeting all applicable New Brunswick and City of Moncton requirements, and fasten it according to the manufacturer’s instructions. You must also wear suitable footwear.

You must also wear suitable footwear (for example, you must not wear high heels or sandals).

Before each ride, and regularly and periodically, as circumstances require, you must conduct a routine safety inspection and checks of the E-scooter or E-bike. Said inspection and checks include but are not limited to the following steps:

You shall not tamper with or alter the E-scooter or E-bike or any equipment in any way, shape or form. You shall not sell and/or distribute the E-scooter or E-bike under any circumstance.

You agree to use the E-scooter or E-bike gently and return the E-scooter or E-bike in normal and suitable working condition. You are not responsible for ordinary wear and tear.

You must not use the E-scooter or E-bike for any commercial purpose or usage, such as delivery, advertising, for hire and reward etc.

A helmet is legally required to ride an E-scooter or E-bike;

You must not ride, operate or travel on a sidewalk under any circumstances. You must travel only on the right-hand side of the travelled portion of the street, in the direction of traffic, follow the rules of the road, and use a bicycle or micro-mobility lane when available.

You agree that Move may track your location and route while using the App to provide Services to you.

The availability and scope of the Services may change with or without notice to you. Move reserves the right to limit its Services to a specific time period, geographic region, or population.

www.ridemove.ca; (2) the mobile application of Move, known as Move Scooter Rental (the "App"); and (3) our electric scooters ("E-scooters" or “E-bikes”), as well as any materials, equipment, products and services that concern the rental or use of E-scooters or E-bike ((1) through (3) collectively referred to as the "Services").

By clicking “agree” you are agreeing to the following:

You, on behalf of yourself, family, heirs, agents, affiliates, personal representatives, successors, guardians and assigns, release, waive claims against, indemnify, defend and hold harmless MOVE SCOOTER RENTAL INC. and the City of Moncton, its elected officials, officers, agents, employees, successors and assigns from claims arising from your use of the E-scooter or E-bike or Services. This release, indemnity, defence and hold-harmless obligation does not apply to the extent that a court of competent jurisdiction finally determines that a claim, damage, liability, loss, cost or expense was caused by the negligence or wilful misconduct of the City of Moncton or a City Protected Party.

You, the customer, shall learn and practice how to ride the E-scooter or E-bike properly and safely. You assume all the risks and losses in connection with the E-scooter or E-bike and Services, especially for – but not limited to – those related to and/or arising out of violation of the instructions about warnings and caution statements contained in the Rental Agreement and the Release Agreement. Such risks include but are not limited to loss of control, failure/malfunction of the product, and/or collision.

Such risk may increase if you have physical and/or mental impairment or disability or are under the influence of alcohol, drugs, or a similar substance. Such risk may also increase if you are not sufficiently familiar with the functions, features, and performance of the E-scooter or E-bike or Services.

Move and the Releasees shall not be liable for any claim, liability, and loss related to such consequences if it is due to your assumption of risk. 3) You acknowledge that the use of Move’s E-scooters or E-bikes, and any related Services, is an inherently dangerous recreational activity. You understand that the operation of an E-scooter or E-bike requires physical and mental abilities, and you represent, warrant and agree that you are in sound medical condition, that you are capable of operating the E-scooter or E-bike, and you are voluntarily participating in this E-scooter or E-bike experience with the knowledge of the dangers involved and you agree to accept any and all risks of loss, injury or death.

As such, you agree to follow all rules and guidelines provided by Move, including, but not limited to, those pertaining to safety and to the use of the E-scooter or E-bike. You will at all times wear a CSA, Snell, CPSC, ANSI or ASTM approved helmet and have it properly sized, fitted, and fastened at all times according to the manufacturer’s instructions when riding an E-scooter or E-bike, provided that you also acknowledge that a helmet will not eliminate the risk of bodily injury in the event of an accident. You agree to use and operate the E-scooter or E-bike in a careful, considerate, and safe manner with due consideration for the safety and wellbeing of all persons. You will refrain from harmful conduct of any kind which may damage the E-scooter or E-bike, or affect the safety of others or yourself.

As an E-scooter or E-bike rider, you are responsible for the way you ride and the condition of the E-scooter or E-bike. You take responsibility for damage to an E-scooter or E-bike or third-party property resulting from your actions during the rental and agree to reimburse MOVE SCOOTER RENTAL INC. for lost revenue and reasonable repair or replacement costs for damage to, or theft of, an E-scooter or E-bike in your possession.

You understand this Release Agreement applies on a go-forward basis to all contractual relations between yourself and Move Scooter Rental, in perpetuity, with respect to the Services, until the Release Agreement is amended or as agreed in the future by the parties.

YOU ACKNOWLEDGE THAT YOU ENTER INTO THIS RELEASE AGREEMENT FREELY, KNOWINGLY, AND VOLUNTARILY AND THAT YOU INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE AND WAIVER OF ALL CLAIMS ARISING OUT OF OR IN ANY WAY RELATED TO YOUR USE OF THE SERVICES.

SCHEDULE A — CITY OF MONCTON RIDER TERMS

Application and Incorporation. Schedule A is incorporated into and forms part of the Rental Agreement, Release Agreement, Privacy Policy and other agreements governing the Rider’s use of the Services (collectively, the “Agreements”). It applies to every rental, use, activation, reservation or operation of a Move shared micromobility device within the City of Moncton. If Schedule A conflicts with any other provision of the Agreements, Schedule A governs for activity within the City of Moncton.

City Protected Parties. “City Protected Parties” means the City of Moncton and its elected officials, officers, agents, employees, successors and assigns.

Condition of Use and Evidence of Acceptance. Before any Rider may activate or use a shared micromobility device in the City of Moncton, the Rider must review and affirmatively accept the Agreements, including Schedule A, through the App. Move will maintain a versioned electronic record of the Rider’s acceptance, including the agreement version, date and time, and account identifier, and will provide copies or evidence of acceptance to the City on request.

Pre-Rental App Disclosures. Before activation, Move will display in the App and the Rider must review: that helmets are available for use and that a device must not be operated unless a helmet is worn during the trip; the applicable rate; and any surcharge.. By activating a device, the Rider confirms receipt of those disclosures and acceptance or refusal of the service before use commences.

Device Message and Age Restriction. The Rider acknowledges that each shared micromobility device displays the applicable safety messages, including that no person under 16 years of age may ride or operate it and that a helmet must be worn during the trip. No person under 16 years of age may activate, ride or operate a device.

Rider Release, Indemnity and Defence. To the fullest extent permitted by law, the Rider releases, indemnifies, defends and holds harmless the City Protected Parties from and against all claims, demands, causes of action, proceedings, damages, liabilities, losses, costs and expenses (including reasonable legal fees) arising from or related to the Rider’s rental, activation, use, operation, parking or possession of a shared micromobility device, or the Rider’s breach of the Agreements. This paragraph does not release, indemnify, defend or hold harmless any City Protected Party to the extent that a court of competent jurisdiction finally determines that the claim, damage, liability, loss, cost or expense was caused by that City Protected Party’s negligence or wilful misconduct.

Risk Notice. The Rider understands that shared micromobility involves risks that may result in serious injury, death, property damage and financial loss. Those risks include collision; falls; sudden braking or acceleration; uneven, wet, icy or obstructed surfaces; traffic; pedestrians; other riders; mechanical malfunction; visibility conditions; weather; improper parking; and the Rider’s own acts or omissions. The Rider accepts the risks that remain after reasonable safety precautions.

Insurance Notice and Personal Responsibility. This Rental Agreement is not an insurance policy and does not itself provide the Rider with insurance coverage. The Rider remains responsible for personal injury, property damage and third-party liability to the extent not covered by insurance. If any City-required insurance coverage or benefit is unavailable, excluded or limited and the City has approved alternative risk-management measures, Move will provide the Rider, at the point of rental and before activation, written notice of the applicable coverage gap, exclusion, limitation and resulting personal-liability risk.

Moncton Legal Compliance. For activity in the City of Moncton, references in the Agreements to Halifax Regional Municipality, Develop Nova Scotia, Nova Scotia-specific legislation, or inconsistent local operating rules do not apply. The Rider must comply with all applicable federal, provincial, municipal and City of Moncton requirements, including By-law L-926 as amended or replaced. No person under 16 years of age may ride or operate a shared micromobility device in the City of Moncton. The existing minimum age of 19 years in the Agreements remains applicable where it is more restrictive.

Severability. Each provision of Schedule A is severable. If a provision is unenforceable, it will be read down only to the extent necessary to make it enforceable, without affecting the balance of the Agreements.
