Terms of Use

MOVE SCOOTER RENTAL INC.

WEBSITE TERMS OF USE

Effective Date: October 19, 2026

These Website Terms of Use (the “Terms”) govern your access to and use of www.ridemove.ca, including its public webpages, informational content, forms and related website features (the “Website”). The Website is operated by MOVE SCOOTER RENTAL INC. (“MoVe”, “we”, “us” or “our”), a corporation organized under the laws of New Brunswick, Canada. Please read these Terms carefully. By accessing or using the Website, you agree to these Terms to the extent enforceable under applicable law. If you do not agree, please stop using the Website.

1. Scope; Separate Rental and Privacy Agreements

These Terms govern general use of the Website. They do not themselves authorize any person to rent, unlock, reserve, operate or ride an e-scooter or e-bike. Those activities, and use of rental features in the MoVe mobile application, are subject to the separate MoVe Scooter Rental Agreement and Waiver, any applicable schedules or local operating rules, and the terms presented at the point of rental.

Our separate Privacy Policy governs the collection, use, disclosure, safeguarding and retention of personal information in connection with the Website and other covered services. If these Terms and a specific rental agreement address the same rental transaction inconsistently, the specific rental agreement governs that rental transaction, subject to mandatory law.

2. Canadian Business; Visitors Outside Canada

MoVe is based in New Brunswick, Canada. The Website may be viewed from other countries, but worldwide availability of the Website does not mean that MoVe offers rentals, delivery, customer support, promotions or other services in every country. Rental services are offered only in locations that MoVe identifies as active service areas and where their operation is permitted.

Visitors are responsible for complying with laws applicable to their own use of the Website. MoVe does not represent that the Website or its content is appropriate, lawful or available in every jurisdiction. Nothing in these Terms excludes the application of consumer protection, privacy or other mandatory rights that apply to a visitor under applicable law.

3. Eligibility and Website Access

You may use general informational features of the Website if you can lawfully do so. If a feature requires an account or involves making a binding transaction, you must have the legal capacity and meet any separate eligibility requirements applicable to that feature. The age restrictions for riding or renting devices are found in the Rider Agreement and applicable local law; access to the public Website does not establish eligibility to ride.

We may reasonably restrict, suspend or block access to protect the Website, its users or our systems from suspected abuse, security threats or unlawful activity, subject to applicable law.

4. Acceptable Use and Prohibited Conduct

You agree to use the Website lawfully and not to: (a) attempt unauthorized access to the Website, accounts, servers or connected systems; (b) introduce malicious code or interfere with security, performance or availability; (c) perform automated scraping, excessive requests or data harvesting that compromises the Website or violates applicable law; (d) impersonate any person or submit intentionally false or fraudulent information; (e) harass, threaten, defame or infringe the rights of others; (f) bypass access controls or interfere with other visitors; or (g) reproduce, distribute or commercially exploit Website materials without authorization, except as permitted by law.

Nothing in this section restricts any activity that applicable law expressly permits and does not allow us to prohibit by contract.

5. Service Information, Locations and Availability

The Website may describe scooters, e-bikes, planned launches, current service areas, parking, safety rules, operating conditions, equipment, promotions or related services. Information is intended to assist visitors and may differ from real-time fleet conditions. A vehicle shown in promotional content or an illustration is not a guarantee of its availability, condition, eligibility for use or location.

For a particular ride, review the current information provided in the MoVe mobile application and the relevant rental terms, including applicable municipal restrictions. Nothing on the Website overrides traffic laws, local bylaws, safety instructions or the actual conditions encountered by a rider.

6. Prices, Promotions and Advertising

Prices, promotions, referral offers, discounts, bonus credits, eligibility rules and service availability are subject to the specific terms clearly disclosed with the applicable offer or transaction. Where a rental is available, the app and the applicable Rider Agreement set out the rate and contractual charges for that rental. Taxes and other charges will be disclosed as required by applicable law.

MoVe will not use these Terms to excuse false or misleading advertising, conceal mandatory charges or remove consumer rights. If an advertisement, offer or online transaction is subject to statutory price-disclosure, cancellation or refund rights, those rights continue to apply notwithstanding these Terms. Promotional offers may be restricted by participating location, dates, supply or eligibility where disclosed.

7. Online Forms, Requests and Customer Submissions

Visitors may submit inquiries, support requests, complaints, photographs, documents, feedback or other materials through Website forms. You represent that, to the best of your knowledge, the information you provide is accurate and that you are entitled to submit it. Please do not submit another person’s sensitive information unless reasonably necessary and you are authorized to do so.

You retain any rights you hold in submitted materials. You grant MoVe a non-exclusive, royalty-free permission to receive, store, reproduce and use a submission only as reasonably necessary to process and respond to the matter, maintain records, protect against misuse and operate or improve the relevant service, consistently with the Privacy Policy and applicable law. Public promotional use of identifiable submissions will require appropriate permission.

8. Privacy, Cookies and Website Analytics

Our handling of personal information is described in the MoVe Privacy Policy, available on the Website. It addresses personal information collected through Website forms, communication systems and related service providers, including cookies or similar technologies to the extent used.

Where applicable law requires consent or a choice for particular cookies, analytics, tracking or marketing activities, those requirements apply independently of agreement to these Website Terms. The Website Terms are not a substitute for any consent required by privacy law.

9. Electronic Communications and Marketing

When you contact MoVe or request service, we may respond by email, telephone or text using the contact details you provide, as permitted by applicable law and our Privacy Policy. Service-related messages are distinct from promotional communications.

Where MoVe sends commercial electronic messages, it will obtain any consent required by Canada’s Anti-Spam Legislation or other applicable law, provide legally required identification details and honour valid unsubscribe requests. Merely using the Website does not, by itself, constitute consent to receive unrelated marketing.

10. Intellectual Property and Limited Permission

The Website, including its original text, photos, graphics, visual design, software elements, logos, slogans and other content, is owned by MoVe or its licensors and is protected by applicable intellectual property laws. Subject to these Terms, MoVe grants visitors a limited, revocable, non-exclusive permission to view and use the Website for lawful personal or informational purposes.

You may not use MoVe names, trademarks, branding or logos in a manner suggesting affiliation, authorization or endorsement without written permission. You may reproduce materials to the extent permitted by fair dealing, statutory exceptions or other applicable law. No intellectual property ownership is transferred to visitors through Website access.

11. Third-Party Platforms, Links and Services

The Website may contain links to maps, social media platforms, app stores, support portals, payment service providers and other third-party services. These providers may have their own legal terms and privacy practices. A link does not necessarily mean that MoVe endorses the third party or controls its content.

MoVe is not responsible for the independent acts, omissions or content of third parties except to the extent responsibility cannot lawfully be excluded. Please review the applicable third-party terms before using those services.

12. Website Security and Reporting

We may use reasonable administrative, technical and organizational measures to operate and protect the Website, although no internet service can be guaranteed to be completely secure. You should take reasonable precautions with your own device, browser, passwords and internet connection.

If you identify a suspected vulnerability, fraudulent Website, impersonation attempt or other security concern, please contact MoVe through www.ridemove.ca/support. Do not attempt to exploit a suspected vulnerability or access information that is not yours.

13. Website Content and Disclaimer

We seek to keep public Website information useful and accurate, but typographical errors, delayed information, interrupted access or technical problems may occur. To the extent permitted by applicable law, general Website content is provided for informational purposes on an “as available” basis, without a guarantee of continuous availability or that it meets every visitor’s individual needs.

Nothing in these Terms disclaims a representation or warranty that cannot be lawfully disclaimed, removes a statutory consumer remedy, or restricts liability for fraud, wilful misconduct, or other conduct for which exclusion is prohibited by law.

14. Limits of Liability

To the fullest extent permitted by applicable law, MoVe is not liable for indirect, incidental, special or consequential loss arising solely from use of the public Website, such as loss resulting from a temporary Website outage or a third-party link, where such exclusion is legally permitted.

This provision does not govern claims relating to scooter or e-bike rental, operation, accidents, bodily injury or property damage, which are addressed by applicable law and the separate Rider Agreement.

Nothing in these Terms limits or excludes liabilities, warranties, remedies or rights that cannot legally be limited or excluded, including non-waivable rights under consumer protection law. Any limitation must be interpreted only to the extent enforceable in the relevant circumstances.

15. Consumer Rights and Online Transactions

If MoVe permits a purchase, booking, deposit, voucher or other transaction through the Website, the transaction may be subject to additional transaction-specific terms disclosed before acceptance. Any required pre-contract disclosures, opportunity to review and correct information, receipts or contract copies, refund rights and cancellation rights will be provided as required by law.

For consumers protected by New Brunswick law, applicable provisions of the New Brunswick Consumer Protection Act and regulations govern where in force and relevant. These Website Terms do not replace disclosure obligations or restrict rights under any applicable consumer legislation.

16. No Professional or Safety Advice

General Website materials regarding scooters, e-bikes, riding, parking, road rules or other matters do not replace applicable laws, official instructions, traffic signs, product safety notices or case-specific professional advice. Riders must comply with the applicable Rider Agreement, the MoVe app instructions and local requirements. Website visitors should verify important information through appropriate official sources.

17. Governing Law and Disputes

These Terms are governed by the laws of New Brunswick and the applicable federal laws of Canada, without regard to conflict-of-law rules to the extent legally permissible. Subject to mandatory consumer protection, jurisdiction and procedural laws, disputes relating solely to the Website may be brought before courts of competent jurisdiction in New Brunswick, Canada.

This provision does not deprive any consumer of mandatory protections or access to a court or tribunal where applicable law does not permit such rights to be waived. Nothing in these Terms imposes mandatory arbitration, waives class proceeding rights or excludes statutory remedies.

18. Severability; No Waiver; Entire Website Terms

If any provision is held unlawful or unenforceable, it will be limited or severed to the minimum extent necessary, while the remaining provisions continue to apply to the extent permitted by law. A failure by MoVe to enforce a provision on one occasion is not a waiver of the right to enforce it later.

These Terms address public Website use and are to be read alongside, rather than as a replacement for, MoVe’s Privacy Policy and separate Rider Agreement. They do not override any rights or obligations established by mandatory law.
